Acceptable Use Policy

This Acceptable Use Policy (“Policy” or “AUP”) governs the use of Internet access and related services (“Services”) provided by Byhalia.net, LLC (“Byhalia.net”).
This Policy is intended to protect Byhalia.net, its customers, its network, other networks, and Internet users from unlawful, abusive, harmful, fraudulent, or disruptive activity.
By using Byhalia.net Services, customers agree to comply with this Policy, the applicable service agreement, the Open Internet Policy, and other applicable Byhalia.net policies and terms.
General Acceptable Use
Customers may use Byhalia.net Services for lawful personal, residential, business, educational, entertainment, and other legitimate purposes consistent with their applicable service plan.
Customers are responsible for activity originating from their Internet connection, account, network, and connected devices to the extent reasonably within their control.
Customers are expected to take reasonable precautions to secure their networks, computers, routers, wireless devices, passwords, accounts, and other Internet-connected equipment.
Use of the Services must not interfere with the operation of the Byhalia.net network, adversely affect other customers, violate the rights of others, or violate applicable law.
Illegal Activity
Customers may not use or permit the Services to be used for unlawful activity.
Prohibited activity includes, but is not limited to, using the Services to create, access, possess, transmit, distribute, facilitate, solicit, or promote material or activity that violates applicable federal, state, or local law.
Byhalia.net reserves the right to cooperate with lawful investigations and respond to subpoenas, court orders, warrants, and other valid legal process as required or permitted by law.
Network Security and Unauthorized Access
Customers may not use the Services to compromise, attempt to compromise, disrupt, or gain unauthorized access to computers, accounts, networks, systems, or data.
Prohibited activities include, but are not limited to:
- Unauthorized access or attempted unauthorized access to computers, accounts, networks, or systems.
- Hacking or attempted hacking.
- Password cracking or credential attacks.
- Unauthorized port scanning, vulnerability scanning, probing, or network reconnaissance.
- Circumventing authentication, security controls, or access restrictions.
- Intercepting communications or data without authorization.
- Introducing malicious software or code into any computer or network.
- Exploiting security vulnerabilities without authorization.
- Using another person’s account, credentials, network, or computing resources without authorization.
Legitimate security testing of systems owned or expressly authorized by the customer is not prohibited provided the activity does not adversely affect Byhalia.net, its network, other customers, or third parties.
Malware, Botnets and Harmful Software
Customers may not knowingly use the Services to create, distribute, operate, control, or facilitate:
- Viruses.
- Worms.
- Trojan horses.
- Ransomware.
- Spyware.
- Malicious scripts or software.
- Botnets.
- Command-and-control systems.
- Credential-stealing software.
- Other malicious or harmful software or systems.
Byhalia.net may restrict or isolate devices or connections reasonably believed to be infected, compromised, or participating in malicious activity.
Denial-of-Service Attacks and Network Disruption
Customers may not initiate, participate in, facilitate, or knowingly permit denial-of-service (DoS), distributed denial-of-service (DDoS), packet flooding, amplification attacks, or similar activities intended to disrupt or degrade a network, computer, service, or Internet connection.
Customers may not intentionally generate traffic designed to interfere with the operation of Byhalia.net or another network.
Spam and Electronic Messaging Abuse
Customers may not use Byhalia.net Services to send, distribute, facilitate, or enable unsolicited bulk email, spam, fraudulent messages, phishing messages, or other abusive electronic communications.
Prohibited activity includes, but is not limited to:
- Sending unsolicited bulk or commercial email in violation of applicable law or accepted Internet practices.
- Operating an open mail relay.
- Operating a mail server primarily for spam or other abusive activity.
- Sending email using forged, misleading, or unauthorized sender information.
- Phishing or impersonating another person or organization for fraudulent purposes.
- Using compromised computers or accounts to distribute email or messages.
- Collecting email addresses or other contact information through unlawful or abusive means.
- Continuing to send messages to recipients who have properly requested that such communications stop when applicable law requires honoring that request.
Byhalia.net may block or restrict ports, protocols, addresses, domains, or traffic associated with spam, malicious email, compromised systems, or other security threats when reasonably necessary to protect the network and Internet users.
Servers and Internet-Connected Services
Byhalia.net does not generally prohibit customers from operating lawful servers, applications, remote-access systems, security-camera systems, gaming services, home automation systems, or other Internet-connected services for legitimate purposes.
Such systems must comply with this Policy and may not be used for illegal, fraudulent, malicious, abusive, or harmful activity.
Customers are responsible for reasonably securing Internet-accessible systems they operate.
Byhalia.net may restrict a server, application, device, port, protocol, or connection when reasonably necessary to address a security threat, compromised system, network abuse, unlawful activity, or material adverse effect on the network or other customers.
Copyright and Intellectual Property
Customers may not use the Services to infringe copyrights, trademarks, patents, trade secrets, or other intellectual-property rights.
This includes unauthorized reproduction, distribution, publication, transmission, downloading, uploading, or sharing of copyrighted material when such activity violates applicable law.
Byhalia.net may respond to properly submitted copyright complaints and other lawful notices concerning alleged intellectual-property infringement.
Repeated violations may result in appropriate action, including restriction or termination of Services when required or appropriate under applicable law and Byhalia.net policies.
Fraud, Phishing and Impersonation
Customers may not use the Services to commit or facilitate fraud, identity theft, phishing, financial scams, impersonation, deceptive practices, or other fraudulent activity.
Customers may not intentionally misrepresent their identity, authorization, affiliation, or the origin of communications for unlawful or fraudulent purposes.
Harassment, Threats and Harmful Conduct
Customers may not use the Services to make unlawful threats, engage in unlawful harassment or stalking, or engage in other conduct prohibited by applicable law.
Nothing in this provision is intended to restrict lawful speech or communications.
Network Integrity and Reasonable Use
Byhalia.net operates a shared fixed wireless broadband network.
Customers may not use the Services in a manner that intentionally or unreasonably disrupts, damages, overloads, or materially degrades the Byhalia.net network or service provided to other customers.
Byhalia.net does not impose monthly data limits on its standard Internet service plans.
High bandwidth consumption by itself is not necessarily a violation of this Policy. However, automated, malicious, abnormal, or abusive traffic that materially interferes with network operation or other customers may be investigated and managed.
Byhalia.net may use reasonable network-management practices to protect network reliability, security, performance, and availability as further described in the Byhalia.net Open Internet Policy.
Wireless and Radio-Frequency Interference
Customers may not intentionally operate equipment in a manner that unlawfully interferes with, disrupts, jams, or damages Byhalia.net’s wireless network or other lawful communications.
Customer-owned networking or wireless equipment must be operated in compliance with applicable laws and regulations and must not cause harmful interference to Byhalia.net equipment or Services.
If customer-owned equipment is causing harmful interference or network disruption, Byhalia.net may require the customer to disconnect, relocate, reconfigure, repair, or replace the equipment as reasonably necessary to restore proper network operation.
Byhalia.net Equipment
Unless purchased by the customer or otherwise agreed in writing, equipment provided by Byhalia.net remains the property of Byhalia.net.
Customers may not intentionally damage, modify, open, relocate, reprogram, disable, sell, transfer, or tamper with Byhalia.net-owned equipment without authorization.
Customers may not alter equipment settings or configurations in a manner that interferes with Byhalia.net’s network or circumvents service or security controls.
Customers must provide reasonable access to Byhalia.net-owned equipment when necessary for authorized maintenance, repair, replacement, removal, or recovery, subject to applicable service terms.
Unauthorized Resale or Redistribution of Service
Customers may not resell, commercially redistribute, or provide Internet access to unrelated third parties for compensation using a residential or other service plan that does not authorize such activity.
Normal sharing of a residential Internet connection with members of the customer’s household and personal guests is permitted.
Business, landlord, multi-tenant, public Wi-Fi, hotspot, resale, or other commercial redistribution arrangements may require prior authorization or an appropriate Byhalia.net service agreement.
Account and Service Security
Customers are responsible for taking reasonable steps to protect their accounts and connected equipment against unauthorized access.
Customers should use secure passwords and maintain appropriate security on routers, wireless networks, computers, cameras, smart devices, and other connected equipment.
Customers should promptly notify Byhalia.net if they become aware of:
- Unauthorized use of their account or connection.
- Compromised Byhalia.net equipment.
- Malware or botnet activity affecting their connection.
- A security incident that may adversely affect the Byhalia.net network.
Customer Responsibility
Customers are responsible for ensuring that persons using their connection are informed of and comply with this Policy to the extent reasonably within the customer’s control.
A customer should not knowingly permit another person to use the Services in violation of this Policy.
Customers are not automatically considered in violation solely because their equipment becomes compromised without their knowledge. However, customers may be required to take reasonable corrective action after being notified of a security problem or other harmful activity originating from their connection.
Investigation and Enforcement
Byhalia.net may investigate suspected violations of this Policy when reasonably necessary to protect the network, customers, other Internet users, or Byhalia.net’s legitimate interests.
Depending upon the nature and severity of a violation, Byhalia.net may take reasonable actions including:
- Contacting the customer.
- Requesting corrective action.
- Blocking or filtering malicious or harmful traffic.
- Restricting affected ports, protocols, devices, or services.
- Temporarily isolating compromised equipment.
- Temporarily suspending Internet service.
- Terminating service for serious or repeated violations.
- Preserving or providing information when required by applicable law or valid legal process.
- Referring suspected unlawful activity to appropriate authorities when required or permitted by law.
Byhalia.net may take immediate action without prior notice when reasonably necessary to address an active security threat, prevent network damage, protect other customers, respond to unlawful activity, or mitigate a serious disruption.
When circumstances reasonably permit, Byhalia.net may attempt to contact the affected customer and provide an opportunity to correct the problem.
No Waiver
Failure by Byhalia.net to enforce a provision of this Policy in a particular circumstance does not waive Byhalia.net’s right to enforce that provision or another provision in the future.
Changes to This Policy
Internet technologies, security threats, network conditions, laws, and acceptable-use standards evolve over time.
Byhalia.net reserves the right to modify this Policy when reasonably necessary to address changes in technology, network operation, security, law, regulation, or business practices.
Material revisions will be posted on the Byhalia.net website as appropriate.

When reporting suspected abuse, please provide sufficient information to allow Byhalia.net to investigate the matter, such as relevant IP addresses, dates, times, logs, message headers, or other available information.
Related Policies
This Acceptable Use Policy should be read together with Byhalia.net’s Internet Service Agreement, Open Internet Policy, Customer Privacy & CPNI Policy, and other applicable service terms.
If any provision of this Policy conflicts with applicable law or regulation, applicable law or regulation will control.
